A trademark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others.
Any party that uses a registered trademark can be sued.
We have demanded copycat vendors and resellers to cease and desist use of registered trademarks for several reasons:
- This use violates registered trademarks
- Use of these trademarks with copycat products convey that LiveO2 is equivalent to demonstrably inferior products
- Any commercial interest that reproduces the trademark is also subject to damages.
A Registered trademark is filed with the US Patent and Trademark office. Registered trademarks can only be used under license by the trademark registrant.
Legal Notifications:
An unregistered trademark is the property of the owner but the laws regarding damages are less strict. The only requirement for a an unregistered trademark is that the it is claimed.
